Payment Terms 

  • Contracts are based on Verbal, Written or Emailed agreements (via Quickbooks or otherwise), and/ or Consideration has passed. 
  • Quotations are only valid for the specification detailed, and up to a period of one month, or as specified.  
  • The prices included in any contract may be subject to inflation in costs, GST, freight, materials, and labour beyond our control. 
  • Quotations exclude any local taxes (GST) or builders (third party) commission or retentions. 
  • No invoice will be subject to retention, unless otherwise agreed in advance. 
  • There will be staged invoices made during the contract, based on deposits required by our suppliers to process the ordering of materials, work undertaken, and materials held in our store. Payment is required within 7 days (28 days for Pool Service): 
  • All invoices are due to be settled on the 28 day terms for Pool Servicing.
  • All invoices are due to be settled on 7 day terms for all Maintenance/ Day Works Contracts or Jobs.
  • All invoices are due to be settled on 7 day terms for all Site Works Contracts.
  • Cancellation of contract (either verbally, electronically or in writing) will incur a 50% charge plus full payment on any materials or equipment ordered on the Client’s behalf. 
  • Upon cancellation if a job is complete or part complete but not paid, then all outstanding monies are due immediately.
  • Work In Progress (WIP): If cancellation has taken place and items have been ordered and not delivered they immediately become the property of RPH Heating Limited t/a Florida Pools.
  • Upon cancellation – labour up to and including this point will become immediately due.
  • Any invoices outstanding for payment will be subject to a 2% above base interest rate after 7 days. 
  • Unless full payment has been received beforehand, any stock will remain the property of RPH Heating Limited t/a Florida Pools.  
  • Any Guarantees exclude consequential losses of any kind whatsoever. 
  • Any variation from the original specification will result in an extra charge.  
  • All guarantees/ warranties remain 100% void until balance on contract has been received in full. 
  • Notice of any defect shall be given to the installer in writing within the respective periods above mentioned. 
  • RPH Heating Limited t/a Florida Pools and Spas shall make best endeavours to limit any delays but can not be held responsible if any (weather/ staffing/ freight or otherwise) delays are incurred. 

Please note that we need a confirmed order with deposit before we do any detailed design work, order equipment or consumables, or allocate any stock or time slots to the project. 

N.B:

Details of all the manufacturer guarantees/warranties are available on request. None of the above covers replacement water if required.

1 – Time of delivery and installation 

Delivery date of materials and equipment to site and installation date to be agreed between the parties.  

2 – Miscellaneous 

  • Landscaping or remedial works to granite walls are not included. 
  • Drainage works or moving mains drains are not included. 
  • Capping wells are not included. 
  • This warranty shall not cover or extend to any damage arising from emptying the pool. 
  • The pool is serviced at all material times per prior agreement by Florida Pools.
  • Replacement water is not covered under any warranty at any time. 
  • No equipment is ordered, or work booked into our schedule until the required deposit has been settled. 
  • Brochures and Images are used as a guideline only. Scale, sizing, shade and positioning of patterns, textures and colours may vary. 
  • The samples held by Florida Pools, which the Client chose tiles or pattern from, contain the following footnote – NOTE: Due to a combination of printing, cutting, and manufacturing methods, it is not always possible to achieve a pattern colour match as batch numbers will be different– pool owners must be made aware of this – aesthetic quality is not regarded as a guaranteed issue.    

The contract is deemed as accepted once the first payment has been made.

Explanation of our Account Charges 

  • Included in our rates are overhead costs of an engineer, workshop foreman, secretary, clerk, public and employer’s liability insurance, property rent, rates, renewals, repairs, telecoms, social security, holiday pay, staff training, health & safety training, and ITIS & GST management. 
  • There are also small separate charges added to each individual invoice to cover cartage, transport & tools and materials, fixings, and sundries. Cartage and transport incorporate vehicle depreciation, insurance, maintenance, and fuel. Tools include such items as drills, machinery, and the continual repair and maintenance of such items. 
  • Materials, fixings, and sundries cover the cost of fixings, screws, bolts, nuts, washers, gaskets, glue, cleaner, threaded rod, channel etc. 
  • Our Staff are charged out from the time that they leave the workshop until they return. 
  • All labour is booked by the full hour only, no part hour charges. Labour charges will apply to office time sourcing parts and labour on the road to collect/source parts. 

4 – Insurance 

It is recommended that the Client inform their property insurers about the proposed installation to check if it will increase the buildings insurance premium. 

5 – Commissioning the system 

To be performed by Florida Pools & Spas personnel with nominated electricians in attendance. 

6 – After-Sales Support and Maintenance 

In order to fulfil warranty requirements – our Florida Pools servicing division will be required to oversee the swimming pool management upon contract completion (or when the pool water has been installed) at the current published service costs per hour plus chemicals/additional parts used.
